1. Eligibility and acceptance

1.1. Overview: these terms and conditions (the “terms”) govern your use of the finup system and its associated services (collectively, the “services”).

1.2. Acceptance: by accessing or using the finup system and its services, you confirm that you have read, understood, and agreed to these terms. Your continued use of the services constitutes your acceptance of any updates or modifications to these terms.

1.3. Eligibility: the finup system and services are available only to individuals who are at least 18 years old or the legal age of majority in their jurisdiction. By using the services, you represent and warrant that you meet these eligibility requirements.

1.4. Public offer: these terms constitute a binding agreement between you and finup. If you do not agree with any part of these terms, you must not use the finup system or its services.

2. Governance and compliance

2.1. Regulation and authority: finup retains the right to govern and regulate any matters not explicitly addressed in these terms. This includes, but is not limited to, operational procedures, policies, and guidelines related to the finup system and services.

2.2. Compliance: by using the finup system and services, you agree to comply with these terms and any additional policies or regulations that may apply. The terms are available on the finup website, and it is your responsibility to review them periodically.

2.3. Modification of terms: finup reserves the right to modify these terms at any time, with or without notice to you. Your continued use of the finup system following any changes constitutes your acceptance of the modified terms. It is your responsibility to stay informed of any changes.

2.4. Administrator’s discretion: the administrator of the finup system has the discretion to implement, amend, or revoke policies or regulations at any time, provided such changes are consistent with the overall purpose of these terms.

3. Definitions of terms

3.1. Account: a virtual profile created by a customer within the finup system, established in accordance with these terms. Unless otherwise specified, "account" refers to a personal account.

3.2. Applicant: an individual who expresses an intention to create an account and initiates the registration process through the finup system.

3.3. Authorization details: the combination of login and password used to authenticate a user’s identity within the finup system.

3.4. Authorization: the process by which a user’s identity is verified using their login and password.

3.5. Chargeback: the procedure initiated by a cardholder to reverse a bank card transaction through their bank.

3.6. Contact details: information provided by a customer, including but not limited to, email address, used for communication purposes within the finup system.

3.7. Customer: an individual who has successfully registered and created an account, and is authorized to use the finup system and services in accordance with these terms.

3.8. Dormant account: an account that has not been accessed or logged into for a period of one year or more.

3.9. Fees: charges imposed by finup for providing the system services to a customer.

3.10. Funds: electronic currency held by a customer and recorded within the customer’s wallet.

3.11. Login: the method used by a customer to access their account, which may be the customer’s email address or a user-defined alphanumeric identifier.

3.12. Parties: collectively refers to finup and a customer involved in transactions or interactions within the finup system.

3.13. Password: an alphanumeric combination selected by a customer during registration, used in conjunction with the login to access the account.

3.14. Payment order: an electronic instruction submitted by a customer via the finup system to execute a transaction.

3.15. Payment: the transfer of funds within a wallet, either from a customer to a third party or from a third party to a customer.

3.16. Personal account: an account created by an individual for personal use and access within the finup system.

3.17. Prohibited activities: actions or behaviors that involve criminal offenses in the customer's or finup's jurisdiction; the sale or distribution of prohibited goods or services; activities forbidden under applicable laws; or violations of universally accepted standards of ethics and morality.
